Do Law Firms Influence Who Wins Investment Disputes?

07/09/2026

What gives some parties an edge in international investment arbitration?

By Jonas Bunte

On March 10, the Institute for International Political Economy hosted the first session of this term's Socioeconomics Research Seminar, featuring Clint Peinhardt (University of Texas at Dallas). In his talk, "Law Firms in Investor-State Dispute Settlement," Professor Peinhardt examined the role of law firms in shaping the landscape of international investment arbitration, arguing that experienced law firms can enhance their clients' probability of winning, but in an asymmetric fashion that benefits multinational corporations more than states. The talk brought a political economy lens to a topic often treated as purely legal and was followed by a lively discussion.

We are grateful to Professor Peinhardt for contributing to the department’s research seminar with his valuable findings!
