Terms and conditions

The following terms and conditions apply to your participation in the talent show “WU’s Talents.” The terms and conditions are available on the WU website at wu.ac.at/wus-talents until the end of the talent show. By participating in WU’s Talents, you accept and agree to these terms and conditions.

Participation

Applications are only accepted via our website at wu.ac.at/wus-talents. Participation is voluntary and free of charge.

All WU employees, students, WU researchers, alumni, and partners, and all other persons with a connection to WU are eligible to participate.

To participate, you have to submit a completed application form and the contribution (photo/video) in which you show your talent.

WU reserves the right to exclude participants who do not fulfill the participation requirements from the talent show at any time.

Casting and vote

You can participate in one of the available categories (music; dance, acrobatics & magic; literature, visual & performing arts, and comedy & entertainment), either as an individual participant or as part of a group. In your application, you can indicate whether you would like to perform during the live show event or prefer to only participate in the vote.

WU will preselect participants from all contributions received. The selected contributions may be published on the WU’s Talents website, where they will be accessible to the public until the live show event in December 2022. In a subsequent selection procedure, a jury composed of WU’s Talents participants will select the contributions for the live show event in an online vote. All participants who have submitted a contribution but do not want to perform at the live show event themselves become members of the jury of participants and will be able to participate in the online vote. The definitive selection of contributions for the live show event will be made by an honorary jury.

Participants do not have a legal claim to participate in the talent show/the live show event. WU reserves the right to replace participants who, for whatever reason, are unable to participate in the live show event. Participants have no legal claims if they drop out before the end of the talent show for whatever reason, if they are excluded from the talent show, or if the show is terminated prematurely before its scheduled end.

The participants do not receive any compensation or remuneration for their participation.

All contributions must comply with WU’s netiquette rules and the WU Advertising Directive (Werberichtlinie). In particular, it is not permitted to show any pornographic, racist, discriminatory, violent, or morally objectionable content. WU reserves the right to withhold publication of specific contributions or delete them if they include prohibited or undesirable content.

Copyright, usage rights

You grant WU permanent, non-exclusive rights to use all works and performances created in connection with your participation. In particular, this transfer of rights applies to all contributions uploaded via the website (photos/videos) and any contributions made as part of the live show event.

Video and audio recordings will be produced as part of the live show event. By participating, you grant WU the right to publish recordings of you and make comprehensive use of these recordings without remuneration, in particular for broadcasting the show event (live, video stream, on-demand video), for related PR and promotional activities, and for WU’s general public relations work. A diverse range of channels may be used for this purpose, including the WU website, the wu-memo, WU’s social media channels (especially Facebook, Instagram, and LinkedIn), press releases, cooperation projects with media partners, and online and print media. You irrevocably waive the right to control the reproduction of your personal image.

WU is entitled to transfer the rights granted pursuant to these terms and conditions to third parties (in particular WU’s cooperation partner), partially or in full, without obtaining your specific consent.

You declare that you are authorized to transfer the abovementioned rights and that you have not transferred them to any third parties.

You must be free from any contractual obligations with third parties (e.g. exclusive artist agreement, publishing agreement, recording contract, hiring contract, performer agreement) if the terms of such contracts are incompatible with participation in WU’s Talents and/or these terms and conditions.

If your contribution includes content created by other people that involves third-party copyrights and/or usage rights (e.g. compositions, texts and lyrics, playback recordings, film footage), you must inform WU, discuss the use of third-party content with WU, and obtain approval from WU. In the case of musical works, you have to provide WU with the name of the composer(s) and lyricist(s) and the exact duration of the piece of music used. In general, the precondition for obtaining WU’s approval for performing a cover song is that the song must not be adapted (e.g. no new lyrics, no translation, etc.). If playback is to be used, the precondition for WU’s approval is that the holder of the usage rights must have authorized the use of the material in public performances/broadcasts. Film footage may only be used if approval has been obtained from the holder of the relevant rights.

If the material used shows other persons, you confirm that the persons in question have explicitly consented to the publication of the material, and you also confirm that no personality rights are infringed upon. In the event that any third parties nevertheless bring claims against WU because of infringement of their rights, you shall indemnify WU and hold it harmless.

Exclusion of liability

WU shall only accept liability for damage that was caused intentionally or as a result of gross negligence. WU shall not assume any liability for ordinary negligence, except in cases of personal injury.

Insurance

If I participate in the live show event and my performance may pose risks to my health (e.g. acrobatic performances), I shall take all necessary safety precautions on site at my own responsibility. I shall also obtain a health/accident insurance policy that covers these risks. Upon request, I shall present appropriate proof of such insurance coverage to WU.

Amendments and modifications

WU reserves the right to change the procedures of the talent show and the terms and conditions for participation at any time if this is required due to organizational reasons or other legitimate interests and if these changes are reasonable with regard to the participants’ interests because they are minor and justified by legitimate reasons. On its website, WU will inform the participants about any changes that may be made. The participants have the right to withdraw their participation at any time.
